JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 13-052015 on the accusation that he, having entered the house of informant, attempted to commit rape on her.

Submission on behalf of petitioner is that there was previous enmity between the family members of the petitioner and family members of the informant and as a matter of fact, much prior to institution of the present case, the grandfather of the informant had lodged Amdabad P.S. Case No. 25 of 2014 against the petitioner and when the petitioner got bail in the aforesaid case on 11-04-2014, the grandfather of the informant set up the informant and got instituted this false case.
