JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 25.12.2017 seeks bail in connection with Mahila P.S.Case No. 196 of 2017 registered under Sections 376, 323, 341 and 506 of the Indian penal Code.

Allegation in brief is that petitoner is the brother-in-law of the elder sister of the informant came one night and established sexual relation with her.

Submission is that prosecutrix is major and from her statement recorded under Section 164 Cr.P.C. it reflects that it was a consensual sexual relation.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Kamlesh Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties

Patna High Court Cr.Misc. No.17987 of 2018 (2) dt.29-03-2018 2/2 of the like amount each to the satisfaction of the learned SDJM, Nalanda, Biharsarif in connection with Mahila P.S. Case No. 196 of 2017.
