JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 Earlier prayer for bail of the petitioner was rejected twice by this Court by order dated 4.7.2017 passed in Cr. Misc.No. 15297 of 2017 and allegation against the petitioner is of kidnapping of minor daughter of the informant and also committing rape upon her.
Submission of learned counsel for the petitioner is that he is in custody since 22.11.2016 and there is no substantial progress in the trial as only two witnesses have been examined in this case till date.
Heard learned APP and perused the report of learned trial court from which it appears that out of 7 charge-sheeted witnesses three witnesses have been examined and the court has assured that trial will be concluded within a period of six
Patna High Court CR. MISC. No.47581 of 2019(3) dt.21-08-2019 2/2 months if parties co-operate in disposal of trial. In the facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months from the receipt of this order. It is made clear that if trial is not concluded within the said period petitioner is at liberty to move before the trial court for grant of bail, which will be considered by the trial court and appropriate order will be passed.
With the above observation, this application is dismissed.
