JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 25.12.2017, seeks bail in Lauriya PS Case No. 331 of 2017 registered under Sections 304(B), 201 and 34 of the IPC.

The allegation in brief is that the husband and other family members killed daughter of the informant for non fulfillment of dowry and it is alleged that this petitioner and others after death got the dead body cremated.

Learned Counsel for the petitioner submits that there is no allegation of committing torture and of killing against the petitioner, he is not a family member of the deceased, except the allegation that he got the dead body buried there is no other material against him and he is in custody in this case since 25.12.2017. Having considered the said facts and circumstances, the petitioner, namely, Mustufa Baitha @ Mustafa Baitha is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bettiah, West Champaran in connection with Lauriya PS Case No. 331 of 2017.
