In the background of strain relationship, it has been alleged by the informant Md. Akhtar Ansari that all the accused so named, unnamed including the petitioner armed variously came at his house and during course thereof, Allauddin Ansari gave lathi blow over Reyaz Ansari while Jallabuddin Ansari assaulted with iron rod. When informant intervened, Masoom Ansari @ Fanna Ansari and Afzal Ansari @ Gori Ansari began to throttle. Wife of informant namely Baby Praveen came in rescue who was assaulted by others. Seeing the same, father of informant namely, Md. Ahmad Ansari came in rescue who was assaulted by Saddam with farsa. On hue and cry villagers began to assemble however, during midst thereof, all the accused persons assaulted them. He along with his wife, father, Reyza were taken to doctor by the police and from there, Reyaz was referred to PMCH during midst thereof, he died. There happens to be no specific allegation attributed against the petitioner. After concluding investigation, charge
sheet had already been submitted. Petitioner happens to be Patna High Court Cr.Misc. No.1422 of 2018 (2) dt.11-01-2018 under custody since 06.10.2017 having no criminal antecedent as per para-3 of the petition.
That being so, petitioner Tabarakh Ansari is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Jogapatti (Nawalpur) P.S. Case No.331/2017.
