JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 29-08-2025 Learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application filed on behalf of the petitioner no. 2, namely, Raju Singh, in connection with Natwar P.S. Case No. 12 of 2025, pending in the court of learned Additional Judicial Magistrate-Ist Class, Bikramganj, Rohtas.
2. Permission is accorded.
3. Accordingly, the present anticipatory bail application filed on behalf of the petitioner no. 2, namely, Raju Singh, is dismissed as withdrawn.
4. Heard learned counsel for the petitioner no. 1 and learned Additional Public Prosecutor for the State.

5. The petitioner no. 1 is apprehending his arrest in a case in connection with Natwar P.S. Case No. 12 of 2025 dated 12.01.2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 126(2), 109, 324(2), 352 and 351(2) of the B.N.S., 2023.
6. As per the prosecution case, the informant went to his farm, he saw that three goats were grazing his wheat plants. On protest, the co-accused Bharat Singh started abusing and assaulting him on his head by means of lathi. Thereafter, all the accused persons alongwith the petitioner no. 1 arrived at his house armed with lathi, sword, Gadasa and pistol and attacked his elder brother, due to which, he sustained head injury. When the informant and his son came to rescue him, they were also assaulted by means of Gadasa, due to which, they sustained injury.
7. Learned counsel for the petitioner no. 1 has submitted that he is innocent and has falsely been implicated in this case. There is general and omnibus allegation against him. There is no specific allegation against him. There is a case and a counter case between the parties. The doctor has examined the informant Diwakar Chaubey and his elder brother Mahendra Nath Chaubey and has opined the injury of both injured is
3/4 grievous in nature caused by hand and blunt substance but the injury has been found on non-vital party of the body of the injured. It is further submitted that the other co-accused persons, namely, Bharat Singh and Omprakash Singh @ Prakash Singh have already been granted regular bail by a Bench of this Court in Cr. Misc. No. 18522 of 2025 vide order dated 21.04.2025, annexed as Annexure-5 to the present bail application. The petitioner no. 1 has one criminal antecedent as stated in para 3 of the bail petition.
8. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the anticipatory bail petition of the petitioner no. 1.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner no. 1 (except petitioner no. 2, namely, Raju Singh), in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Judicial Magistrate-Ist Class, Bikramganj, Rohtas in connection with Natwar P.S. Case No. 12 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023 with further condition:-
4/4 (I) The petitioner no. 1 is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner no. 1 are liable to be cancelled.
10. The application stands allowed only against petitioner no. 1.
