In this case, the petitioner is seeking bail in connection with Bihta P.S. Case No. 334 of 2014 for offence under Sections 302/379/34 of the Indian Penal Code. There is a direct allegation against the petitioner to have killed the deceased by giving dagger blow on the chest. Looking to the entire facts and circumstances of the case as also the nature of allegation, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, namely, Dharmendra Bhagat is rejected.

The court below is directed to expedite the trial of the

Patna High Court Cr.Misc. No.21395 of 2016 (2) dt.19-05-2016 petitioner. If the trial is not concluded within a period of one year from today, the petitioner will be at liberty to renew his prayer for bail.
