JUSTICE AMARESH KUMAR LAL ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307, 504, 506/34 of IPC and Section 27 of the Arms Act.
Allegation against the petitioner and his brother Shriman Narayan is to have quarrelled with their father, informant and both of them shot fire but the informant entered into his room and saved his life.
It is submitted that there had been family dispute and the wife of petitioner had also lodged Mahendia P. S. Case No. 18 of 2015 on the same day for the offence punishable under Sections 354-B, 379 and other minor Sections of IPC and 27 of the Arms Act against the informant, his son Radhika Raman Prasad and
Patna High Court Cr.Misc. No.31433 of 2015 (2) dt.18-08-2015 2/2 grandson Ravinesh Ranjan.
It is further submitted that in similar facts and circumstances, co-accused Shriman Narayan has been granted anticipatory bail by this Court vide Cr. Misc. No. 33449 of 2015. The petitioner has been in custody since 25.5.2015. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Brajesh Nand Tripathi, Judicial Magistrate, 1st Class, Jehanabad/court concerned in Mahendia P. S. Case No. 17 of 2015 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
