JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402, 307, 414 & other minor sections of the Indian Penal Code and Sections-25(i-b)a/26/27/35 of the Arms Act. One loaded country-made pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner, when the petitioner and others were arrested by the police while they had assembled to make preparation for committing dacoity and, they also made firing on the police party.

Submission on behalf of petitioner is that the petitioner is languishing in jail custody since 15-10-2015 and

Patna High Court Cr.Misc. No.28281 of 2016 (3) dt.27-09-2016 2/2 having more or less similar allegation, one co-accused namely, Rajesh Paswan has already been granted privilege of bail by this court.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Lakhisarai P.S. Case No. 671 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai. (Hemant Kumar Srivastava, J) A.K.V./- U T
