The petitioner seeks bail in connection with Lakhisarai (Kabaiya) P.S. Case No.54 of 2016 registered under Sections 406, 419, 420, 467, 468 and 379/34 of the Indian Penal Code. It is contended by the learned counsel for the petitioner that mere recovery of certain ATM cards from possession of the petitioner in itself constituted no criminal offence. It is further contended that the petitioner has never ever been made accused in any other case and is in custody in the present case since 6th February, 2016. He has submitted that the petitioner has got roots in the society and, in case of grant of bail, he is not likely to abscond or tamper with the evidence.

Regard being had to the facts and circumstances of the case, the petitioner, namely, Santosh Kumar, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S.
