The petitioner has been in custody since 21.08.2017 in connection with Khagaria (Mufassil) P.S. Case No. 634/2016 registered for the offences punishable under Sections 302/201/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that merely on suspicion, the petitioner's name has been drawn in connection with the present case. It is submitted that the informant has named the petitioner only on the presumption that they had gone together on 07.11.2016, but on 10.11.2016, the body of the informant's brother was found. Learned counsel for the petitioner, therefore, submits that, save and except the said situation as stated

Patna High Court Cr.Misc. No.3595 of 2018 (3) dt.17-02-2018 2/2 in the First Information Report, there is no further material to implicate the present petitioner and only on such presumption, the petitioner's name has been brought in the present case. It is further submitted that one Balbir Sahni, similarly named, has been extended the privilege of regular bail in Cr. Misc. No. 2712 of 2018 vide order dated 12.02.2018.

Having gone into the merits of the entire facts and circumstances and there being only suspicion against the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria, in connection with Khagaria (Mufassil) P.S. Case No. 634/2016.
