The petitioner seeks bail in a case under Section 272, 273 and 420 of the Indian Penal Code and under section 47(a) of the Excise Act.

The police intercepted a truck in which 4400 liters of spirit was being carried but nobody was arrested. Four persons are said to have made their escape.

It is submitted that driver of the truck Jai Ghanshyam has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 19359/2015. Co-accused Rajeev Kumar Singh @ Rajeev Singh has also been enlarged on bail vide order passed in Cr. Misc. No. 22555/ 2015 and the case of petitioner stands on same footing.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.28967 of 2015 (2) dt.10-08-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Baniapur P.S. Case No. 36/2015.
