Petitioner seeks regular bail in Kasba P.S. Case No.202 of 2017 instituted for the offence under Section 379 of the I.P.C. The informant has lodged the case of theft of the motor cycle after five days of the occurrence and as per the F.I.R. the petitioner was seen roaming near his house on the alleged date of theft. It is alleged that the motor cycle has been recovered from garage of Md.Sahjada in Ranipatra Chowk.

It has been submitted by the petitioner that he has been falsely implicated in this case as there is no role of the petitioner in theft of motor cycle and he has clean antecedent and he is in custody since 23.10.2017.

No.2208 of 2018 (3) dt.08-02-2018 2/2 Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Purnea, in Kasba P.S.Case No.202 of 2017.
