In view of the submission that the petitioner no.1 (Kamta Ram) has been arrested during the pendency of this application, as such this application against the petitioner no.1 stands dismissed as withdrawn.
So far other petitioners are concerned, they are apprehending their arrest in connection with Kargahar P.S.Case No.110/2019 , registered for offences punishable under
Patna High Court CR. MISC. No.46611 of 2019(2) dt.29-07-2019 2/3 Sections 147, 149, 341, 323, 307, 354A, 379, 504 of the Indian Penal Code.
Allegation as per the written report is that the petitioners came and the petitioner no.1 has assaulted by lathi and allegation against another co-accused is that he assaulted the grand father by Katta and other petitioners are also named and there is general allegation of assault.
Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and the occurrence took place with respect to petty matter.
Heard learned A.P.P. and the learned counsel for the informant.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Sasaram in connection with Kargahar P.S.Case No.110 of 2019, subject to conditions as laid down under Section 438 (2) of the
Patna High Court CR. MISC. No.46611 of 2019(2) dt.29-07-2019 3/3 Code of Criminal Procedure.
