2. The petitioner has prayed for bail registered for the offence punishable under Sections 126(2), 115(2), 109, 303(2), 351(2), 352 and 3(5) of the B.N.S., 2023.
3. The case of the prosecution, in short, is that the informant was being assaulted by Md. Irshad @ Ghutwa, Md. Lal Babu, Munni Khatoon and others due to which he received injuries. Only allegation against this petitioner is that she has asked the informant as to why he has objected her son while he was consuming intoxicants.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. She has been falsely implicated in this
Patna High Court CR. MISC. No.48079 of 2026(2) dt.23-07-2026 2/3 case. He also submits that there is absolutely no allegation of assault against this petitioner. Petitioner is a lady who is aged about 60 years and she is languishing in judicial custody since 30.04.2026.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner has got criminal antecedent of ten cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laherisarai P.S. Case No. 160 of 2026 with the following conditions:- (i) Petitioner shall co-operate in the trial and shall remain present on each and every date fixed by the learned Court below and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
(ii) One of the bailors shall be his near relative. (iii) The petitioner shall also mark his weekly
