JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 01.03.2016 in connection with Araria Mahila P.S. Case No. 11 of 2016 for the offences instituted under Sections 376 of the IPC and 4, 6 and 8 of the POCSO Act.

The accusation is of committing rape upon the informant's daughter by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 01.03.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering with the evidence against the petitioner. Patna High Court Cr.Misc. No.21317 of 2016 (3) dt.22-07-2016 2/2 examined under Section 164 Cr. P.C. where she has denied the allegation of rape. The petitioner has falsely been implicated in the present case due to dirty village politics.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum- Special Judge, Araria, in connection with Araria Mahila P.S. Case No. 11/2016.
