JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Digha P.S. Case no. 281 of 2017, registered under Sections 144, 145, 147, 148, 149, 323, 307, 353, 427, 332, 333, 336, 337 and 338 of the Indian Penal Code.

The accusation is that informant was deputed as Executive Magistrate for measurement of the land of CBSE and Passport office in Rajeev Nagar. The informant along with other Police officials reached there and when measurement work was going on then all of sudden, local people reached there raising slogans against the administration and tried to put the JCB on fire. However, Police tried to pacify the matter in the meantime people started pelting stones in which Police officials sustained injury and they also tried to

Patna High Court Cr.Misc. No.55936 of 2017 (2) dt.30-11-2017 2/2 kill the operator of the J.C.B anyhow operator of JCB succeeded to flee away. Thereafter, three JCB machines and a police jeep was put on fire. On enquiry from the labourers, the informant came to know the name of eight miscreants, including the petitioner, who indulged in agitating the mob of 1000 people.

Learned counsel for the petitioner submits that, in fact, petitioner is Ex-Mukhiya of Digha and due to grudge and enmity his name has been disclosed by the people, who used to reside near the place of occurrence. Further submission is that regarding the same occurrence Digha P.S. Case No. 282 of 2017 and Digha P.S. Case No. 283 of 2017 have also been instituted in which petitioner has been made accused in the said cases.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Patna in connection with Digha P.S. Case No. 281 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
