The petitioners seek bail in a case registered under Sections 341, 323, 328, 498A, 302, 201/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
Allegation against the accused persons including the petitioners is that they committed murder of the daughter of the informant due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioners that the petitioners are in custody since 03.10.2017 and 10.10.2017 respectively and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the
Patna High Court Cr.Misc. No.6713 of 2018(2) dt.06-02-2018 2/2 present case. The petitioner No.1 is Gotani, petitioner No.2 is mother-in-law and petitioner No.3 is father-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Runnisaidpur P.S. case No.467 of 2017.
