The petitioner is in custody since 11.10.2014 in connection with Dhaka P.S. Case No. 172 of 2014 for the offence registered under Sections 302, 201, 120B and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is neither named in the first information report nor has connection with the said occurrence. Petitioner, however, submits that though the petitioner is named in the first information report by his parental name as being the son of Ram Vinay Choudhary, he has no connection with the present occurrence and only because of the confessional statement made before the police by one Abhishek Kumar, the name of the petitioner has brought into
Patna High Court Cr.Misc. No.15293 of 2015 (3) dt.28-07-2015 the present case. It is further submitted that apart from said Abhishek Kumar, no other persons have come forward to support that the petitioner is also part of the occurrence or was present at the place of occurrence. It is further submitted that petitioner is a Tempo Driver and he has no criminal antecedent. Considering the aforementioned submissions as also the fact that petitioner has no criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sikrahana at Motihari in connection with Dhaka P.S.
