The petitioner seeks Anticipatory bail in connection with Birpur P.S. Case No. 116 of 2017 registered under Sections 302, 201 and 120B of the Indian Penal Code.

Informant is the father of the deceased in his FIR on 11.05.2017 has stated that yesterday at about 7 'o' clock in the evening two persons namely, Arjun Mandal and Arvind Mandal had come to his house who were known from previously to them and took away his son Naresh Mandal with them, but even after much time he did not return then he searched but in the night who could not be located and in the morning he received information that his son has been killed and thrown away near power house and he has further stated that one Niranjan Mukhiya, Ranjeet Mukhiya and Golu Sharma (Petitioner) had

Patna High Court Cr.Misc. No.58340 of 2017(5) dt.19-02-2018 2/2 an altercation with his son with respect to some money transaction and as such he suspects that they have killed him. Except suspicion there is nothing against the petitioner and it has been further submitted that main accused Arvind Mandal And Arjun Mandal have already been granted regular by this Court and Ranjeet Mukhiya has been granted bail by the court below. It has been further stated that petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, (Supaul) in connection with Birpur P.S. Case No. 116 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
