This is a case of misuse of privilege of bail. Submission is that petitioner is in custody since last six months and this is first misuse by the petitioner. The petitioner was out of station to earn livelihood. Hence, pairvi of the case was not done properly.

Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kotwali (Barari)

Patna High Court CR. MISC. No.3266 of 2021(2) dt.05-04-2021 2/2 P.S. Case No.225 of 2005, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.

(d) With further condition that if the petitioner would commit further misuse that would be a ground to keep the petitioner in custody till conclusion of the trial. (Birendra Kumar, J) Mkr./- U T
