JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302 and 201/34 of the Indian Penal Code. Allegation against the petitioner is that he along with two other accused hired a Tata Majic Van for going to Warsaliganj and the deceased, nephew of the informant, went with them. Thereafter, he did not return. Later on, dead body of the deceased was found in river Sakri and two persons were apprehended by public while throwing the dead body and the Tata Majic Van was also lying there. Petitioner confessed his guilt before the police. It has been submitted on behalf of the petitioner that he is in custody since 23.10.

2015. Chargesheet has been submitted against him. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is said to have been named in the F.I.R. merely on the basis of suspicion. Other co-accused have been granted bail vide Cr. Misc. no. 18954 of 2016, Cr. Misc. no. 5520 of 2016, Cr. Misc. no. 23080 of 2016 and Cr. Misc. no. 22914 of 2016.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada, in connection with Warsaliganj P.S. Case no. 266 of 2015.
