Petitioners seek regular bail in S.Tr.No.455 of 2017 arising out of Amarpur P.S. Case No.30 of 2005 instituted for the offence under Sections 364/201/34 of the I.P.C. It has been submitted on behalf of the counsel for the petitioners that police after investigation finding the case false against the petitioners submitted final form against the petitioners. However, differing with the final form and the evidence collected by the police, the court below had taken cognizance against the petitioners. It is further submitted that they are innocent and they have been falsely implicated in this case and they are in custody since 5.8.2016 having no criminal antecedent.

No.4342 of 2018 (2) dt.15-02-2018 2/2 Considering the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the 1st Additional District and Sessions Judge, Banka, in S.Tr. No.455 of 2017 arising out of Amarpur P.S.Case No.30 of 2005.
