Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition & Excise Act, 2016. There is recovery of 315.480 litres of foreign

Patna High Court CR. MISC. No.3399 of 2021(3) dt.17-11-2021 2/2 liquor from the house of the petitioner.

Considering the fact that the alleged foreign liquor was seized from the house of the petitioner, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.

The Court below is directed to consider the prayer for bail of the petitioner without being prejudiced by the order of this Court, if the petitioner surrenders within a period of six weeks and pray for regular bail. With the aforesaid observation/direction, the application stands disposed off.
