The petitioner apprehends his arrest in Uchkagaon P.S. case No. 171 of 2016 for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that Chandrama Manjhi had earlier executed sale deed with regard to a piece of land in favour of father of the informant but Chandrama Manjhi again wanted to sale the land. When the informant protested the petitioner is alleged to have pierced sword in the scrotum of the informant. The informant became unconscious thereafter other accused persons assaulted the informant.
The learned counsel for the petitioner submits that there is a case and counter case. The petitioner and others also
Patna High Court Cr.Misc. No.153 of 2018 (2) dt.16-01-2018 2/2 sustained injuries but from perusal of the injury report of the informant it appears that there is sharp cut injury on the scrotum of the informant, which is a vital part of the body, and the petitioner is alleged to have pierced sword.
Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
