JUSTICE SATYAVRAT VERMA ORAL ORDER 13-01-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. The petitioners seek regular bail in connection with Laukaha (Lalmaniya) P.S. Case No. 199 of 2021 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners are in custody since 22.06.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.58952 of 2021(2) dt.13-01-2022 2/2 allegation is of recovery of 231 litres of liquor from Maruti Suzuki Zen.

Learned counsel for the petitioners submits that neither the car nor the liquor belongs to the petitioners and they have been falsely implicated in the present case merely because they were present at the place of occurrence. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 22.06.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Laukaha (Lalmaniya) P.S. Case No. 199 of 2021.
