Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act.
The present occurrence appears to have taken place in the year 2005 but petitioner was remanded in this case on 20.12.2015.
Submission on behalf of the petitioner is that the name of petitioner has been dragged in this case by the police after ten years of the occurrence and except criminal antecedent as well as suspicion, there is noting against the petitioner. It is also
Patna High Court Cr.Misc. No.20539 of 2016 (2) dt.19-05-2016 2/2 submitted that having more or less similar allegation, several coaccused have already been granted privilege of bail by different Benches of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bairganiya P.S. Case No. 64 of 2005.
