The petitioner apprehends his arrest in connection with Kamtaul P.S. Case No. 12 of 2017 registered under Sections 392 and 412 of the Indian Penal Code, pending in the court of S.D.J.M., Darbhanga.
The accusation is that on 26.01.2017, in the evening, when the informant was returning to his house closing his mobile shop. In the way, three persons stopped his motorcycle and amongst them, one pointed the pistol at his head and snatched motorcycle and gold chain and started to move from there. On raising alarm, villagers surrounded the miscreants, in which, one was apprehended, while two miscreants succeeded to flee away. The apprehended person disclosed his name Ravi Kumar Mishra
Patna High Court Cr.Misc. No.11099 of 2018 (2) dt.26-02-2018 and also disclosed the name of his two associates including the name of the petitioner.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
