Petitioner apprehends his arrest in a case registered for the offence punishable under section 498(A) of the IPC and section 4 of D.P. Act.

It has been submitted on behalf of the petitioner that the dispute between the parties has been resolved through the mediation process on the terms of settlement mutually agreed by the parties. It has further been submitted that as per Memorandum of Agreement, maintenance of Rs. 8,000/- per months is required to be deposited since November, 2019 by the petitioner. It has further been submitted that the petitioner is ready to fulfill the terms and conditions of the Memorandum of Agreement.

No.47800 of 2019(5) dt.24-02-2020 2/2 Considering the aforesaid facts and circumstances as well as undertaking of learned counsel for the petitioner, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bettiah, West Champaran in connection with Complaint Case No.1747-C of 2016 (S.C. No. 1247 of 2017), subject to condition as laid down hereinabove and under section 438(2) of the Cr.P.C. with further condition; if the petitioner violates the terms and conditions of the agreement, in that case the learned trial court will be at liberty to cancel the bail-bond of the petitioner.
