Although petitioner is named in the first information report with accusation that he gave fatal blow to the deceased with back portion of spade on her head but submission on behalf of the petitioner is that there was case and counter case between the parties and as a matter of fact, free fight took place between the parties and persons from both sides sustained injury and unfortunately, the injury of deceased of the present case became fatal. It is also pointed out on behalf of the petitioner that father of the petitioner also sustained grievous injury, which is evident from Para-16 of the case diary of the present case.

Patna High Court Cr.Misc. No.30998 of 2015 (3) dt.14-10-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Raghunathpur P.S.Case No. 190 of 2014.
