It would appear from perusal of the impugned order that cell phone and pocket diary containing names of several persons are said to have been recovered from the possession of the petitioner. It is not clear from the impugned order that seized mobile and diary are stolen property or used in commission of the alleged crime. Moreover, having more or less similar allegation co-accused Ashok Kumar Paswan @ Ashok Paswan has already been granted privilege of bail by this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sitamarhi in Sursand P.S. Case no. 33/2015. shahid (Hemant Kumar Srivastava,J) U T
