====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 27-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Kanti P.S. Case No.5 of 2015 registered under Sections 304(B)/34 of the Indian Penal Code, pending in the court of the S.D.J.M. West, Muzafarpur.

The accusation is of killing the daughter of the informant by her husband and in-laws for non fulfillment of the dowry demand by pressing her neck.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the deceased, the daughter of the informant, and there is general and omnibus

Patna High Court Cr.Misc. No.21937 of 2016 (4) dt.27-07-2016 2/2 allegation against the petitioner and his family members to cause death to the deceased by pressing her neck. The petitioner is in custody since 04.12.2015.

On the other hand, learned A.P.P. for the State submits that the deceased died within two years of her marriage at her sasural and in the post-mortem report of the deceased, the cause of death has been shown as strangulation.

Having regard to the facts and the circumstances of the case and the nature of the allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
