The petitioners apprehend their arrest in connection with Bangra P.S. Case No. 63 of 2020 registered under Sections 302, 328 and 34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. There is no specific allegation against the petitioner no. 2 who is mother-in-law of the deceased. Further submission is that petitioners have no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed
Patna High Court CR. MISC. No.4486 of 2021(4) dt.06-12-2021 2/2 the prayer of petitioner no. 1 by contending that petitioner no. 1 is the husband of the deceased. There is allegation of committing murder of the deceased against him. Having considered the facts and circumstances of the case, prayer of the petitioner no. 1 for grant of anticipatory bail is rejected.
So far as prayer of petitioner no. 2 is concerned, his prayer for grant of anticipatory bail is allowed. Let the above named petitioner no. 2 be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the S.D.J.M., Samastipur in connection with Bangra P.S. Case No. 63 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
