JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Trial No. 941 of 2017, arising out of Complaint Case No. 516-C of 2006, disclosing offences under Sections 323, 504, 420 and 423 of IPC.

Complaint case disclosed an allegation that complainant has received a warrant issued against him in a criminal case filed by the petitioner no.1, but on enquiry he came to know that the petitioner had executed a lease agreement pertaining to his land, in which his forged signatures was also

Patna High Court CR. MISC. No.47326 of 2019(2) dt.30-07-2019 2/2 appeared on the same and he has got a case instituted, in which, warrants has been issued against the complainant. Submission of the learned counsel for the petitioners is that the whole allegation is false and concocted and moreover, in the nature of civil dispute. They have no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-13th, East Champaran, Motihari, in connection with Trial No. 941 of 2017, arising out of Complaint Case No. 516-C of 2006, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
