This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office.
Petitioner seeks bail in Rajauli PS Case No. 336 of 2019 registered under Section 395 of the IPC.
The truck driver has lodged the present case that when he was returning after unloading the stones he was stopped by a white colour Scorpio and four miscreants tied his hands and took away the truck.
Learned Counsel for the petitioner submits that based on his antecedent he has been implicated in this case on suspicion, though he is on bail in the four earlier cases as per averments made in para 3 of this petition. He was arrested and remanded in this case on 1.8.2020 and has never been put on T.I. parade. There is no recovery from the petitioner.. Charge-sheet has been filed in this case. Other co-accused namely Buipin Kumar and Vinay Kumar have since been
Patna High Court CR. MISC. No.3544 of 2021(2) dt.08-02-2021 2/2 allowed bail in Cr. Misc. No. 6455 of 2020 and Cr. Misc. No. 10181 of 2020 respectively.
Learned APP has opposed the prayer for bail.
Considering the rival submissions as also the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nawada in Rajauli PS Case No. 336 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
