The petitioner is in custody in a case registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code. It is alleged by the informant that his father was assaulted by the accused persons and his father become unconscious and thereafter he was brought to hospital for treatment.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 13.4.2015.Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. No motive is alleged against the petitioner. No deadly weapon is
Patna High Court Cr.Misc. No.29626 of 2015 (3) dt.16-10-2015 2/2 said to have used in course of the occurrence. The date of occurrence is 5.4.2015. The case was instituted on 9.4.2015. There is no explanation of delay in instituting the case. On behalf of the State, it has been submitted that the petitioner is named in the FIR and he had played active role in the occurrence.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar Bharti, Judicial Magistrate, 1st class, Patna, in Budha Colony P.S.Case No. 93/2015.
