The petitioner who is in custody since 15.05.2019 has filed the instant application for grant of bail in connection with Basantpur P.S. Case No. 152 of 2019 (District- Siwan) registered for the offence punishable under sections 341,323,406,420,504 and 506 of the Indian Penal Code. As per the allegation in the FIR, the petitioner is said to have made an attempt to rob the informant while he was withdrawing money from A.T.M. It is further stated that he also threatened the informant by showing knife but on the assistance of other persons in the vicinity, the petitioner was caught red handed.

It is submitted by learned counsel for the petitioner

No.47160 of 2019(3) dt.25-09-2019 2/2 that the allegation as narrated in the F.I.R. are false and concocted and the petitioner had also gone to withdraw money from the said A.T.M. and became victim of misunderstanding. No such occurrence has taken place and he is in custody since 15.05.2019.

The application for bail was opposed by learned APP for the State who submits that there is direct allegation against the petitioner who was caught red handed and that the petitioner has criminal antecedent as stated in paragraphs 3 of the application.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner was caught red handed by the informant along with others at the place of occurrence itself and has criminal antecedent, this Court is not inclined to grant bail to the petitioner and as such the petitioner's application for bail is rejected.
