JUSTICE BIRENDRA KUMAR ORAL ORDER 02-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 307, 341, 323, 325, 504, 147, 148, 149 of the Indian Penal Code. The petitioner and others allegedly assaulted to the deceased. Allegation against the petitioner is of commission of assault with Lathi.

Submission is that the Doctor has found cut injury at the head of the deceased which was not attributed against the petitioner. From the acts alleged, cannot be interfered that the petitioner was intending to commit murder.

Petitioner is in custody since 22.12.2017.

Investigation of the case is already complete.

Patna High Court Cr.Misc. No.18095 of 2018 (2) dt.02-04-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nasriganj (Rajpur) Police Station Case No.04 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
