The petitioner is languishing in custody since 24.03.2016 in a case registered for the offences punishable under sections 341, 323, 324, 328, 498A, 504, 506, 511/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand and made an attempt to kill the informant by administering poison to her.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and at earlier point of time the petitioner has filed Matrimonial Suit No. 1118/2016 with a prayer for divorce and thereafter the present case was lodged.
Patna High Court Cr.Misc. No.21503 of 2016 (2) dt.17-05-2016 2/2 The impugned order reflects that the learned court below made an attempt to reconcile the issue but the informant failed to appear in the Court.
Considering filing of matrimonial suit at earlier point of time and reluctance of the informant in reconciling the issue, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga, in connection with Bahadurpur (Sonki) P.S.
