JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 26-03-2018 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner for quashing the first information report of Uchakagaon P.S. Case No.3 of 2017 registered on 06.01.2017 under Sections 467, 468, 471, 420, 341, 323 and 120B read with 34 of the Indian Penal Code. On query, learned counsel appearing for the petitioner fairly submitted that he is not aware about the present stage of investigation of the case. He submitted that he cannot say as to whether investigation is over or is still continuing.

Patna High Court Cr.Misc. No.15613 of 2017 dt.26-03-2018 In view or the nature of allegations made in the first information report as also in view of lack of knowledge regarding the stage of investigation of the case, I am not inclined to quash the first information report. Accordingly, the application is dismissed. However, the petitioner would be at liberty to challenge the order passed by the court below in case any adverse police report is submitted against him on completion of investigation.
