====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-03-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State.

Petitioners are apprehending their arrest in a

Patna High Court CR. MISC. No.7975 of 2021(4) dt.07-03-2022 2/3 case registered in connection with Rajoun( Nawada Bazar) P.S.Case No. 498 of 2019 for the offences punishable under Sections 120, 498, 494, 379, 376 and 406/34 of the Indian Penal Code.

This case relates to cruelty due to non fulfillment of dowry demand and outrage the modesty by the accused person ( Dewar).

Learned counsel for the petitioners submits that petitioner is falsely implicated in this case. In spite of service of notice complainant has not appeared before this court. It is submitted by the complainant herself, that she solemnized 1st marriage with Niranjan Tanti was the villager of the petitioners and complainant solemnized second marriage with Bilash Tanti which is annexed as Annexure-2 to this petition. There is general and omnibus allegation against the petitioners. Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the

No.7975 of 2021(4) dt.07-03-2022 3/3 petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Banka in connection with Rajoun ( Nawada Bazar) P.S Case No. 498 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
