Petitioner seeks bail in a case registered under section 379 of the Indian Penal Code.

The prosecution case as per the F.I.R. is that one Birendra Sharma submitted a written report at P.S. Civil lines alleging therein that on 13.1.2015 at about 2 P.M. he has come with motorcycle near Crane School and he has gone inside the house some necessary work and when he came out, he found his motorcycle bearing No. BR02R-462 had been stolen. It is submitted on behalf of the petitioner that petitioner is in custody since 14.01.2015 and charge sheet in the case has been submitted. Petitioner is not named in the first

Patna High Court Cr.Misc. No.29446 of 2015 (2) dt.05-08-2015 2/2 information report and his name has appeared in course of investigation.

On behalf of the State it is submitted that petitioner is not named in the first information report and one key is said to have been recovered from his possession. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in Civil Lines P.S.
