ANJANA MISHRA ORAL ORDER 01-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody on his remand since 03.09.2014 in connection with Sessions Trial No. 437 of 2014 - 4973 of 2014, arising out of Bhabua P.S. Case No. 395/2014 registered for the offences punishable under Sections 399,402,120(B) of the Indian Penal Code and 25 (1-b)a, 26 of Arms Act.
Learned counsel for the petitioner submits that, though the petitioner was not arrested from the place of occurrence, his name was subsequently brought into the first information report on the basis of the confessional statement made before the police by co-accused Pappu Kumar Bharti and Vipul
Patna High Court Cr.Misc. No.23316 of 2016 (2) dt.01-06-2016 2/2 Kumr Rai, which has no evidentiary value. It is further admitted that though the petitioner has been implicated in several other cases, where in three cases, the petitioner has been acquitted, whereas in three others, he has been taken into custody on the basis of suspicion and also the fact that co-accused Vipul Kumar Rai has been extended the privilege of regular bail in Criminal Misc. No. 6754/2015 and Pappu Kumar Bharti, who was arrested from the place of occurrence, and has been granted regular bail in Criminal Misc. No. 42053/2014 vide order dated 21.01.2015. Considering the facts and circumstances of the case, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional District & Sessions Judge, Kaimur (Bhabua) in connection with Sessions Trial No. 437 of 2014 - 4973 of 2014, arising out of Bhabua P.S. Case No. 395/2014.
