The petitioner has been in custody since 03.09.2017 in connection with Bail Petition No. 2511 of 2017 arising out of Kotwali P.S. Case No. 449 of 2016 for the offence registered under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the present petitioner is of having inflicted a knife blow. However, in the first information report it is not stated as to on which part of the body, the assault has been made. It is further submitted that the petitioner has no criminal antecedent and so far as the allegation under Section 379 is concerned, there

Learned counsel for the State after perusal of the case diary submits that though the stitched wound is found on the wrist of the informant about 1" in length, later on, it has been found that the same is simple in nature.
Considering the aforesaid facts and circumstances of the case and that the petitioner has already been in custody for the past six months, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 449 of 2016.
