2. The petitioner apprehends his arrest in connection with Hajipur Mahila P.S. Case No. 33 of 2026 dated 14.04.2026 for the offence under Sections 81/318(4)/351(2)/64 of BNSS 2023 & 67 of IT Act.
3. The prosecution story, in brief, is that the informant came in touch with the petitioner through Instagram in March 2025, and their relationship developed over the following months. On March 15, 2026, the petitioner allegedly influenced the informant to travel with him to Viratnagar, Nepal, where they stayed together in a hotel where the petitioner

No.50316 of 2026(2) dt.29-07-2026 2/3 applied vermilion to the informant's forehead under the impression of being husband and wife, leading to a physical relationship during which he captured intimate photographs. After a week, the informant came to know that the petitioner is already married and has children also. When she confronted him, he allegedly threatened to make her photographs viral and forced her to continue the physical relationship. On 03.04.2026, the petitioner allegedly began circulating the intimate photographs on Instagram using a different ID and demanded 5 lakhs from the informant to stop.
4. The Learned counsel for the petitioner submits that the petitioner has a clean antecedent and this is a case of mutual consensual relationship.
5. The Learned counsel for the informant submits that this is not a case of mutual consensual relationship and the consent has been derived because the petitioner misrepresented himself.
6. Learned APP for the State and learned counsel for the Informant vehemently oppose the prayer for bail of the petitioner.
7. Having heard the parties and taking into account the serious allegation of having physical relationship without
Patna High Court CR. MISC. No.50316 of 2026(2) dt.29-07-2026 3/3 valid consent, I am not inclined to grant anticipatory bail to the petitioner.
8. Accordingly, the prayer for grant of anticipatory bail to the petitioner, is hereby, rejected.
9. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be disposed of on its own merit without being prejudiced by this order. (Alok Kumar, J) Anand/- U T
