In this application for anticipatory bail the petitioners apprehend their arrest in connection with Daudnagar P.S. Case No. 197 of 2017 for the offence punishable under section 366 (A) of the I.P.C.
Allegedly, Chandani Kumari, daughter of the informant, was kidnapped by co-accused Jitendra Sao and the petitioners have also their hands in the said kidnapping. During investigation statement of the victim girl has been recorded under section 164 of the Cr.P.C., vide paragraph-62 of the case diary, wherein she has not supported the allegation of kidnapping and has stated that she went out on her own sweet will with Jitendra

Submission is of false implication and that the petitioners have got no concern with the alleged kidnapping, petitioner no.1 is the wife of co-accused Jitendra Sao and against the will of petitioner no.1 Jitendra Sao has taken away Chandani Kumari and now both are living as husband and wife, the petitioner no.1 is herself a victim, she has got four children also and due to the action of the husband they are at the verge of starvation.
The learned A.P.P. fairly submits that the victim girl has not supported the allegation of kidnapping. In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M, Daudnagar, DistrictAurangabad in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
