Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 302, 504, 506/34 of the IPC and under section 27 of the Arms Act. As per the prosecution case, this petitioner along with Sanjay Kumar Ray, caught hold of the husband of the informant and co-accused Ram Darshan Rai opened fire upon him as a result of which he died.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Specific allegation of causing fire injury is against coaccused Ram Darshan Rai. The petitioner along with the other co-accused persons are only alleged to have facilitated the offence.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of

No.48585 of 2022(2) dt.13-12-2022 2/2 arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Raju Kumar 1st class Judicial Magistrate, Samastipur in connection with Patory P.S. Case No. 41 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
