JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 4885 of 2019, arising out of Bahadurpur P.S. Case No. 155 of 2019 registered for the offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. As per prosecution case, police intercepted one Wagon R vehicle from which huge quantity of liquor was recovered and from confidential information names of petitioner and one Laljit were transpired.

Submission of learned counsel for the petitioner is that there is no source of information mentioned in the FIR and there is no recovery from his possession and owner of the vehicle has been granted anticipatory bail by a co-ordinate

Patna High Court CR. MISC. No.46442 of 2019(4) dt.18-09-2019 2/2 Bench of this Court by order dated 17.8.2019 passed in Cr. Misc. No. 51087 of 2019.

Heard learned APP, who has opposed the prayer for anticipatory bail but submitted that case diary does not disclose as to on what basis name of the petitioner transpired in this case, other than confidential information.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna, in connection with Special Case No. 4885 of 2019, arising out of Bahadurpur P.S. Case No. 155 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
