2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Gopalpur P.S. Case no. 192 of 2025 instituted for the offence punishable under Sections 316(2), 318(4), 352 and 351(2) of the BNS.
3. The case of the prosecution, in short, is that informant alleged that her deceased husband had entered into a registered agreement with Rukmani Buildtech Limited to

No.49563 of 2026(2) dt.22-07-2026 2/3 purchase a flat i.e. Flat No. 203, Block- E, Chatrapati Shivaji Green Apartment and on that basis, he has taken housing loan from HDFC Bank, Saguna Mod, Patna. Her husband died during the Covid- 19 pandemic. Allegedly, after payment of the entire consideration amount, builder has not handed over the flat to the informant and he started making excuse one after another. Later on, informant got an information that builder has fraudulently registered the said flat to petitioner no. 1 in connivance with other accused persons. Petitioner no. 2 is identifier of the said sale deed.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. Specific allegation of cheating and fraud have been made against the builder and not against the petitioners. Petitioner no. 1 is the bona fide purchaser of the said flat and petitioner no. 2 is identifier of the alleged sale deed. A statement has been made in para 3 of the bail application that petitioners have got no criminal antecedent.
5. Learned APP appearing on the behalf of State has vehemently opposed the prayer for anticipatory bail.
6. Having heard learned counsel for the parties and in
Patna High Court CR. MISC. No.49563 of 2026(2) dt.22-07-2026 3/3 the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Gopalpur P.S. Case no. 192 of 2025, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Court of Judicial Magistrate 1st Class, Patna subject to the conditions as laid down under section 482 (2) of the BNSS.
