The petitioners apprehend their arrest in connection with Madanpur P.S. Case No.69 of 2016 registered under Sections 341, 323, 325 and 307/34 of the Indian Penal Code. The accusation is that on 27.05.2016 in the morning, Jaiprakash Singh, the father of the informant Rohit Kumar Singh, was talking to the petitioners and one Dhirendra Singh for construction of the tank of the toilet. At that time, there was hot exchange of words in between them in which all caused injury to the father of the informant through danda and garasa.

No.57618 of 2017 (2) dt.15-12-2017 2/2 Learned counsel for the petitioners submits that, on investigation, while the police submitted the final form against the petitioners but submitted the chargesheet against the co-accused Dhirendra Singh. Later on, differing with the final form submitted by the police, the Chief Judicial Magistrate, Aurangabad, took the cognizance of the offence against the petitioners also. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No.69 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
